This Property Owner Agreement is entered into between Nestovo Limited, a company incorporated under the laws of Jamaica, and the property owner or authorized representative registering a property on the Nestovo platform (“Owner”).
By listing a property on the platform, the Owner confirms acceptance of this Agreement and all referenced platform policies.
1. PLATFORM ROLE
Nestovo operates solely as a technology platform and marketplace intermediary.
Nestovo does not own, lease, manage, operate, insure, or control any property listed on the platform and does not act as a landlord, property manager, agent, or insurer of the Owner.
All bookings are contracts directly between the Owner and the customer.
2. ELIGIBILITY AND AUTHORITY
The Owner represents and warrants that:
• they are the legal owner of the property or have lawful authority to list it
• the property may be lawfully rented for short-term or other applicable stays
• all information provided is accurate, current, and not misleading
3. LISTINGS AND CONTENT
The Owner is solely responsible for:
• property descriptions, pricing, availability, and rules
• photos, amenities, and listing content
• compliance with applicable laws, regulations, and building requirements
Nestovo does not verify or guarantee listing accuracy.
4. BOOKINGS AND GUEST RELATIONSHIP
The Owner is solely responsible for:
• honoring confirmed bookings
• providing access to the property
• guest communication and support
• property condition, cleanliness, and safety
Nestovo is not responsible for guest behavior or property condition.
5. PAYMENTS AND PAYOUTS
Payments may be collected by Nestovo on behalf of the Owner.
Payouts are governed strictly by the Payout Policy.
The Owner acknowledges that:
• payouts are released only after eligibility conditions are met
• payouts may be delayed or held due to disputes, refunds, or compliance checks
• Nestovo does not guarantee payout timing
• Nestovo may recover or offset amounts in accordance with the Payout Policy.
6. CANCELLATIONS AND REFUNDS
Cancellations and refunds are governed by the Refund and Cancellation Policy.
If the Owner cancels a confirmed booking:
• the booking may be cancelled
• the customer may be entitled to a refund
• Nestovo may apply platform consequences, including suspension or removal
Nestovo is not responsible for alternative accommodation or compensation.
7. TAXES AND COMPLIANCE
The Owner is solely responsible for:
• all applicable taxes, levies, and statutory obligations
• licensing or permits required for property rental
• compliance with local and national laws
Nestovo does not provide tax or legal advice.
8. INSURANCE AND RISK
The Owner is solely responsible for:
• obtaining and maintaining adequate property insurance
• guest safety and compliance with safety standards
• any loss, damage, or injury occurring at the property
Nestovo does not provide insurance coverage or guarantees.
9. PROHIBITED CONDUCT
The Owner shall not:
• provide false or misleading information
• discriminate unlawfully
• engage in fraudulent or abusive practices
• circumvent platform payment systems
Violations may result in suspension or termination.
10. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Nestovo shall not be liable for:
• property damage
• theft or loss
• personal injury
• guest conduct
• loss of income or profits
• cancellation consequences
Nestovo’s total liability, if any, shall not exceed fees actually received by Nestovo for the relevant booking.
11. INDEMNITY
The Owner agrees to indemnify and hold harmless Nestovo, its directors, officers, employees, and agents from any claims, losses, damages, liabilities, or expenses arising from:
• the property or its use
• guest conduct
• breach of this Agreement
• violation of laws or regulations
12. SUSPENSION AND TERMINATION
Nestovo may suspend or terminate this Agreement and any listing at any time for:
• breach
• risk management
• legal or regulatory concerns
• platform integrity
Termination does not affect accrued rights or obligations.
13. DATA AND PRIVACY
Personal data is processed in accordance with the Privacy Policy.
14. MODIFICATIONS
Nestovo may update this Agreement from time to time. Continued use of the platform constitutes acceptance of updated terms.
15. GOVERNING LAW AND JURISDICTION
This Agreement is governed by and construed in accordance with the laws of Jamaica.
The courts of Jamaica shall have exclusive jurisdiction.
16. ENTIRE AGREEMENT
This Agreement, together with the Terms and Conditions and referenced platform policies, constitutes the entire agreement between the parties relating to property listings.
