Dispute Resolution Policy

This Dispute Resolution Policy forms part of the Terms and Conditions governing use of the Nestovo platform.

By using the platform, all users agree to follow this process before pursuing any external remedies.

1. SCOPE OF DISPUTES

This Policy applies to disputes arising from or relating to:

• bookings and reservations
• cancellations and refunds
• payout timing or eligibility
• affiliate commissions
• merchant orders facilitated through the platform

This Policy does not apply to criminal matters, personal injury claims, or disputes arising outside the platform.

2. PLATFORM ROLE

Nestovo acts solely as a technology platform and intermediary.

Nestovo does not investigate legal liability, determine fault, or provide legal judgments between users.

Nestovo’s role is limited to reviewing information provided and applying published platform policies.

3. HOW TO SUBMIT A DISPUTE

Disputes must be submitted through:

• the official platform dispute form, or
• the official Nestovo support email

Disputes must include:

• the relevant booking, order, or transaction reference
• a clear description of the issue
• any supporting information requested

Disputes submitted through social media, messaging apps, or informal channels will not be processed.

4. TIME LIMITS

Disputes should be submitted within 14 days after the relevant transaction or event. Nestovo may decline disputes submitted after this period where review is no longer reasonably practicable.

5. REVIEW PROCESS

Upon receipt of a dispute:

• Nestovo will acknowledge receipt
• Nestovo may request additional information
• Nestovo will review the dispute solely against platform policies

Nestovo is not required to conduct investigations, inspections, or site visits.

6. PAYMENT HOLDS DURING DISPUTES

During dispute review:

• Nestovo may temporarily hold payouts
• funds are not deemed released or earned until review is complete
• holding funds does not imply fault or liability

This applies to owners, affiliates, and merchants.

7. POSSIBLE OUTCOMES

After review, Nestovo may:

• release held funds
• issue a refund in accordance with policy
• deny the dispute
• close the dispute due to insufficient information

Nestovo’s decision applies only to platform handling of the matter.

8. FINALITY OF PLATFORM PROCESS

Once Nestovo completes its dispute review:

• the platform process is considered concluded
• Nestovo has no further obligation regarding the dispute

Users remain free to pursue external remedies at their own cost and risk.

9. ESCALATION OUTSIDE THE PLATFORM

If a dispute cannot be resolved through this process:

• the matter may be pursued in the courts of Jamaica
• Jamaican law shall apply

Nestovo shall not be joined as a party except where required by law.

10. NO WAIVER

Failure by Nestovo to enforce any part of this Policy does not constitute a waiver of its rights.

11. POLICY UPDATES

Nestovo may update this Policy at any time. Continued use of the platform constitutes acceptance of updated terms.

12. GOVERNING LAW

This Policy is governed by and construed in accordance with the laws of Jamaica.
