PLATFORM POLICIES AND RELATED AGREEMENTS
These Terms and Conditions of Use incorporate and should be read together with the following Nestovo policies and agreements, each of which forms part of these Terms where applicable:
- Privacy Policy
- Refund and Cancellation Policy
- Payout Policy
- Dispute Resolution Policy
- Property Owner Agreement, where a User creates, publishes, manages, or lists a property on the Platform
- Affiliate Agreement, where a User participates in the Nestovo affiliate program

By accessing, registering on, using the Platform, making a booking, listing a property, requesting a payout, or participating as an affiliate, Users agree to comply with these Terms and all applicable platform policies and agreements.
1. DEFINITIONS
“Platform” means the Nestovo website, systems, and related services.
“Company” means Nestovo Limited.
“User” means any person or entity who accesses or uses the Platform, including customers, property owners, affiliates, and sellers.
“Transaction” means any booking, referral, order, or payment facilitated through the Platform.
2. PLATFORM ROLE AND STATUS
Nestovo operates solely as a technology platform and marketplace intermediary.
Nestovo does not own, lease, manage, control, insure, maintain, deliver, or provide any property, product, or service listed on the Platform.
Nestovo is not a landlord, property manager, merchant, service provider, agent, partner, employer, insurer, or fiduciary of any User.
All Transactions are conducted directly between Users, and Nestovo is not a party to any such agreement except as a limited payment facilitator where applicable.
3. ELIGIBILITY AND CAPACITY
Users must be at least eighteen years old and legally capable of entering binding contracts under Jamaican law.
Nestovo may refuse access, suspend accounts, or terminate usage at its sole discretion.
4. USER ACCOUNTS AND RESPONSIBILITIES
Users are responsible for ensuring that all information provided is accurate, current, and lawful.
Users are responsible for safeguarding login credentials and for all activity conducted under their account.
Nestovo is not responsible for unauthorized access resulting from user negligence.
5. LISTINGS, BOOKINGS, AND TRANSACTIONS
Listings are created and maintained by Users, not by Nestovo.
Nestovo does not verify, guarantee, or warrant the condition, legality, safety, quality, accuracy, or suitability of any listing, property, product, or service.
Users enter Transactions at their own risk.
Users who create, publish, or manage property listings on the Platform as hosts or property owners agree to comply with all applicable host obligations, platform policies and the Property Owner Agreement. By listing a property on the Platform, the User confirms acceptance of such obligations and responsibilities.
6. PAYMENTS AND PAYOUTS
Nestovo may collect payments on behalf of Users and release funds in accordance with the published Payout Policy.
Nestovo does not guarantee payment timing, availability, or success of any payout.
Nestovo may temporarily hold funds where required for dispute review, fraud prevention, compliance, or operational risk management.
7. CANCELLATIONS AND REFUNDS
All cancellations and refunds are governed strictly by the Refund and Cancellation Policy and applicable role-specific agreements.
Nestovo has no obligation to issue refunds except as expressly stated in platform policies.
8. NO WARRANTIES
The Platform is provided on an “as is” and “as available” basis.
Nestovo makes no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, safety, accuracy, reliability, or availability.
9. LIMITATION OF LIABILITY
To the fullest extent permitted by Jamaican law, Nestovo shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from:
- use of the Platform
• any Transaction between Users
• property damage
• personal injury
• loss of income, profits, or data
• service failures
• third-party conduct
Nestovo’s total liability, if any, shall not exceed the fees actually received by Nestovo from the specific Transaction giving rise to the claim.
10. NO PERSONAL LIABILITY
To the fullest extent permitted by law, all claims arising from or relating to the Platform or these Terms shall be brought solely against Nestovo Limited. No director, officer, employee, shareholder, contractor, or representative of Nestovo Limited shall be personally liable for any claim, loss, damage, or liability arising from use of the Platform.
11. INDEMNIFICATION
Users agree to indemnify and hold harmless Nestovo, its directors, officers, employees, and agents from any claims, losses, damages, liabilities, costs, or expenses arising from:
- their use of the Platform
• their listings, products, or services
• their breach of these Terms
• disputes with other Users
12. DISPUTE RESOLUTION
All disputes arising from or relating to the Platform shall be handled in accordance with the Dispute Resolution Policy.
Nestovo acts solely as an intermediary and does not adjudicate legal liability between Users.
13. TERMINATION
Nestovo may suspend or terminate access to the Platform at any time for breach, risk, misuse, or legal compliance reasons.
Termination does not affect accrued rights or obligations.
14. MODIFICATIONS
Nestovo may update these Terms at any time. Continued use of the Platform constitutes acceptance of updated Terms.
15. GOVERNING LAW AND JURISDICTION
These Terms are governed by and construed in accordance with the laws of Jamaica.
The courts of Jamaica shall have exclusive jurisdiction.
16. SEVERABILITY
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.
17. ENTIRE AGREEMENT
These Terms, together with all referenced platform policies and agreements, constitute the entire agreement between Nestovo and Users regarding Platform use.
